In this practical webinar, you will learn about recent enforcement of the Health Insurance Portability and Accountability Act of 1996, and how it relates to other upcoming regulations regarding Data Blocking. You will also address what may be expected in new HIPAA enforcement actions. You will review the requirements for documented compliance activities and how to maintain such documentation. You will also explore the tools developed by the US Department of Health and Human Services Office for Civil Rights, such as the HIPAA Audit Protocol of 2018, and their role in establishing compliance and readiness to respond to enforcement investigations and audits.

Current enforcement topics of interest include the provision of individual access of PHI, for which the rules have recently been adjusted to accommodate a Federal court ruling limiting the rights of individuals to direct the delivery of their information to any party. The US Department of Health and Human Services and state attorneys general are also now vigorously enforcing the rules involving HIPAA Business Associates, and entities that do not manage the relationship properly can pay multi-million-dollar penalties in enforcement actions. Moreover, penalties have all been increased by a cost-of-living adjustment, indicating no slackening of interest in HIPAA enforcement at HHS.

  • Outline the kinds of enforcement actions that have taken place involving HIPAA Business Associates, and how to prevent violations leading to enforcement action.

Jim Sheldon-Dean is the founder and director of compliance services at Lewis Creek Systems, LLC, a Vermont-based consulting firm founded in 1982, providing information privacy and security regulatory compliance services to a wide variety of health care entities. He is a frequent speaker regarding HIPAA, including speaking at the annual NIST/OCR HIPAA Security Conference. Mr. Sheldon-Dean has more than 30 years of experience in policy analysis and implementation, business process analysis, information systems and software development, and eight years of experience doing hands-on medical work as a Vermont certified volunteer emergency medical technician. Mr. Sheldon-Dean received his B.S. degree, summa cum laude, from the University of Vermont and his master’s degree from the Massachusetts Institute of Technology.

What is a webinar?

A webinar is simply a seminar that you attend online. You either watch a live video feed of the speaker or listen to the speaker through your computer, tablet or phone’s audio.  You see the speaker’s slides, videos, and other presentation materials on your screen.

Can I ask questions during the webinar?

Yes. During the live webinar, you may submit questions and comments and the speaker will respond verbally. For a recorded webinar, your questions will be emailed to the speaker. You will typically receive a response from the speaker within two business days.

Can I attend using a tablet or smartphone?

Yes. You may attend a webinar using a computer, tablet or smartphone.

If I can’t attend a webinar live, can I view the recording later?

Yes. Shortly after each live program ends, we send all webinar registrants a link to the webinar recording. You can view the recording as many times as you like after the live webinar for up to 12 months.

What is an on-demand webinar?

An on-demand webinar is a previously recorded webinar that you may view at any time after your purchase for up to 12 months.

Can I stop a recorded webinar and start it later at the same point?

Please note that recorded webinars are only eligible for a certain period of time based on the jurisdiction.
