From crises like the COVID-19 pandemic to legal developments such as pregnant worker fairness acts passed by multiple states over the past 18 months, employers need to regularly update their employee handbooks.

  1. Handbook Development

You provide us with some basic information, such as:

  • your current handbook
  • list of states where you have employees working (including from home)
  • your number of employees
  • your industry

We develop a customized employee handbook for your review based on the information you provide, submit a proposed draft for your review, and then consult with you to address any open issues. We provide your finalized handbook in an editable DOCX format as well as a PDF you can distribute to employees.

  1. Monitoring and Updating

We monitor federal law and the law in all 50 states. As laws change that require updates to your handbook, we notify you and provide you an updated employee handbook at no additional cost.

  1. Annual Employee Certification

We recommend that you provide your handbook to employees once a year and ask them to read the handbook and certify that they understand it. Clear Law can provide an online certification process to handle this process for you.


Content of Your Employee Handbook

Our Compliance Advisory Team will work with you to ensure your handbook includes the content required by law and policies recommended as consistent with best practices.

Employer handbooks typically include the following content:

  • Employer-employee relationship policies addressing issues such as at-will employment, employer commitment to equal employment opportunity, employee records, performance evaluations, and separation procedures, among others
  • Workplace policies such as discrimination and harassment prevention, violence prevention, workplace safety, and workplace dress codes
  • Compliance policies including but not limited to those addressing confidentiality, conflicts of interest, acceptable use of company resources, and related policies
  • Work schedule and compensation policies addressing issues such as company business hours, pay periods, overtime, salary basis
  • Leave and time off policies, such as paid company holidays, sick, vacation, or PTO, family and medical leave, state-required family-medical leave, pregnancy leave, or paid leave, as well as jury duty, voting, and bereavement leave

Michael Johnson, J.D., CEO of Clear Law Institute, is a former U.S. Department of Justice attorney who brought one of DOJ’s first “pattern or practice” sexual harassment cases. He is a graduate of Duke University and Harvard Law School.

Alicia Daniel, Senior Compliance Advisor, has advised on highly regulated fields in both the private and public sectors. She served clients as an associate at Foley Hoag LLP, specializing in investigation defense, healthcare law, and cannabis licensing. From there, she joined the Massachusetts Office of the State Auditor, where she advised the agency on employment and compliance matters as Deputy General Counsel. She graduated with honors from Oklahoma Baptist University and Harvard Law School.

Teresa Harvey Rollins, J.D., Senior Compliance Advisor, has nearly 20 years of experience representing Fortune 500 companies and other employers on a broad range of employment matters, including discrimination and harassment prevention. Tes previously practiced law as Counsel at Dickstein Shapiro and was CEO of PolicyPartner LLC, an employment compliance service provider. She is a graduate of Angelo State University and Southern Methodist University’s Dedman School of Law.

Brian Rothenberg, J.D., Senior Compliance Advisor, has advised hundreds of organizations on their compliance training and other compliance needs. An attorney by training, Brian understands both the legal requirements and the other competing challenges organizations face when rolling out compliance training or services. Brian is a graduate of the University of Richmond and the Marshall-Wythe School of Law and the Mason School of Business at the College of William & Mary.
