Users of social networking sites post a wide range of personal information, providing employers broad access into the “private” lives of their employees and applicants. As the law attempts to catch up with rapidly changing technology, employers are left with difficult legal and practical considerations about the parameters for using social networking sights to monitor their employees’ and/or applicants’ activities. While employers have a clear interest in effectively managing their workforce, aggressive use of social networking sites is viewed by many employees as an “invasion of privacy” and is likely to increase the risk of litigation. Therefore, employers must use caution when balancing its right to manage with its employees’ real and perceived privacy rights.

He also has experience handling electronic information to avoid litigation or to help defend employers facing employment-based lawsuits.
