Insurance defense counsel have unique and complicated professional responsibilities arising from their dual relationships with the insured. If not properly attended to from the outset of the relationship with the insured, these relationships can produce intractable ethical dilemmas. Moreover, there is variation by jurisdiction on some issues, with many jurisdictions lacking clear authority on those issues. This webinar will explore key issues and techniques to assure compliance with ethical duties. Among other things, you will learn:

  • How to determine whether the insurer is a co-client with the insured
  • How to determine whether the insured may be entitled to independent counsel and how to react when that is the case
  • What the insured must be told at the outset of the relationship and how that is best done
  • How to manage confidentiality obligations
  • How to deal with insurer involvement in defense decisions

About the Presenter

William T. Barker is senior counsel in the Chicago office of Dentons U.S. LLP. Mr. Barker represents insurers in complex litigation, including matters relating to coverage, claims handling, sales practices, risk classification and selection, agent relationships, and regulatory matters. Mr. Barker is a co-author of Insurance Bad Faith Litigation, Second Edition and of Professional Responsibilities of Insurance Defense Counsel. Mr. Barker is is an Adviser to the ABA on the Restatement of the Law of Liability Insurance. He is also a Special Advisor to the ABA Standing Committee on Ethics & Professional Responsibility. He is a graduate of University of California, Berkeley – School of Law.
