Studies estimate that 80% of the value of a typical business is from its intellectual property (“IP”). IP tools such as trademarks, copyrights and patents, while different in purpose and application, may sometimes be leveraged to protect the same subject matter in different ways. This is particularly the case with product configuration, i.e., the way a product or product feature looks. Product configuration can be a major driver for the commercial success of a product.

In this webinar, you will learn about IP tools for protecting product features that are unique in appearance. The course will cover topics such as:

  • Which aspects of product configuration may be protected by copyright, trademarks and/or patents
  • The various remedies available to victims of product configuration IP infringement
  • What a design patent is and how it differs from a utility patent
  • How to distinguish between protectable “non-functional” product features and unprotectable “functional” features for design patents, copyrights and trademarks
  • Steps to take in marketing and promotion to secure and strengthen product configuration trademark rights
  • Recent legal developments on copyright protection for expressive elements on clothing
  • Who owns the IP in a given product configuration?
  • International aspects of product configuration IP
