Overcoming Bad Faith Allegations in Insurance Claim Investigations – OnDemand

Original Recording Date: July 13th, 2015
Duration: 75 minutes

Policyholders are often quick to file suits alleging bad faith by insurers in the claim investigation. Such allegations, if proven, can lead to significant damage awards against insurers. In this practical webinar, you’ll learn what insurers can do to defeat such allegations or at least mitigate damages. Among other things, you’ll receive answers to the following questions:

  • What are insurers’ obligations in coverage investigations?
  • What are the implications of various court decisions and local laws concerning bad faith in claim investigations?
  • What are the consequences of:
    • Investigating,
    • Failing to investigate, or
    • Conducting an inadequate investigation after a coverage suit is filed
  • How do bad faith allegations in claim investigations impact insurers’ decisions on:
    • Whether to disclaim or deny coverage,
    • How and when to renew or update an investigation,
    • Reservations of rights and ongoing investigations, and
    • Coverage determination
  • What are an insurer’s best defenses to claims that the insurer acted in bad faith?
