Handling Payroll Overpayments Correctly

Employees can be overpaid in even the most well managed payroll department.  When overpayments occur, employers need to adhere with IRS and state tax regulations governing overpayments. Furthermore, wage and hour law compliance must also be honored when dealing with overpayments. This webinar will provide an overview of how to handle payroll overpayments correctly. Upon completion of the course, you’ll be able to:

– Describe how to handling overpayments under IRS and state tax codes:

  • Explain why a 1990 IRS Private Letter Ruling on handling overpayments applies today
  • Identify why and how to correct overpayments in the same calendar tax year
  • Explain why asking for the gross is better than the net check for prior year overpayments
  • Describe the impact on FICA taxes for a prior year overpayment
  • Describe the impact on FUTA/SUI taxes
  • Explain how to use Form W-2 or Form W-2c to report overpayments

– Recognize wage and hour laws and their impact on recouping overpayments:

  • Describe the standards under the FLSA in terms of timeframe for recouping prior year overpayments
  • Explain whether written agreement for repayment always required under the FLSA
  • Describe how to collect overpayments from exempt employees and its effect on salary basis compliance
  • Explain how to recoup overpayments and its effect on minimum wage and overtime requirements
  • Identify when employers should treat advanced vacation payments as overpayments if an employee terminates
  • Explain where states stand on recouping overpayments
