FCPA Risks From Third Party Conduct – On-Demand

Original Recording Date: February 2nd, 2016
Duration: 75 minutes

In this practical webinar, you’ll receive step-by-step guidance on the Foreign Corrupt Practices Act (“FCPA”) and how to protect your company from liability for third party conduct. You’ll learn about the risks of third-party agents, intermediaries, distributors and consultants, and how you can effectively use your audit rights to minimize those risks.  Among other things, you’ll learn answers to the following questions:

  • Are companies liable for the misconduct of a third party if the company does not know what the third party is doing?
  • How often do U.S. enforcement agencies punish companies for the actions of third parties?
  • How can my company protect itself against liability?
  • Why does my company need to have audit rights in contracts with third parties?
  • What should audit rights include?
  • How do third parties avoid compliance with audit rights, and how can I anticipate that?
  • Is it better not to have audit rights than to have them and not use them?
  • Should attorneys be involved in the audit process for privilege reasons?
  • What are some red flags that we should monitor?
  • Who should actually conduct the audits?
