Cognitive Interviewing Technique for Investigations and Litigation – On-Demand

Original Recording Date: October 3rd, 2016
Duration: 90 minutes

Witness testimony is often the most important evidence in litigation and corporate investigations. Researchers, however, have found that witnesses often struggle to communicate the details of what they witnessed and report inaccurate details.

In this webinar, you will receive step by step guidance on how to interview witnesses with the Cognitive Interviewing technique. Developed with support from a U.S. Department of Justice grant, the Cognitive Interview technique has been tested in over 100 studies and shown to greatly increase the amount of information witnesses recall without decreasing the accuracy of the information they provide. You will learn about the following:

  • How witnesses encode their memory of an event
  • Why memory is not like a videocamera recording
  • How memories can be altered
  • Why witnesses struggle to effectively communicate their memories
  • How to avoid poor interviewing techniques
  • How to implement each phases of the Cognitive Interview
  • How to use the Cognitive Interview with the accused

You will receive a checklist with sample language for each of the following stages of the Cognitive Interview:

  • Introduction/rapport building
  • Context reinstatement
  • Free narrative
  • Drawing (if appropriate)
  • Follow-up questioning
  • Varied recall (including reverse-order technique)
  • Challenge (if appropriate)
  • Review
  • Closure
